For people with a Stoop number

PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES THROUGH INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR TO TAKE PART IN A CLASS ACTION. YOU CAN OPT OUT WITHIN 30 DAYS OF REGISTERING.

1. Who we are

Stoop is operated by Bisban Group LLC, a New York limited liability company, doing business as Stoop. In these terms, "Stoop", "we" and "us" mean that operator. "You" means the person who holds a Stoop number.

2. Agreeing to these terms

You accept these terms by checking the box on the registration form and submitting it. If you do not agree, do not register.

These terms and the Privacy Policy together are the whole agreement between you and us about Stoop.

3. What Stoop does

You give us your delivery details once. We give you a six-digit Stoop number. When someone wants to send you an order, they give that number to a participating shop instead of asking you for your address. The shop looks the number up, sees your delivery details, and fulfills the order.

You authorize us to share your name, address and phone number with any participating shop that enters your Stoop number and the last four digits of your phone number.

Stoop only connects you and the shop. We do not sell, make, handle, pay for, insure or deliver anything, and we do not process payments. The sale is between the sender and the shop.

4. Eligibility and your details

You must be 18 or older to register.

By registering, you confirm that the phone number is yours, that you are entitled to receive deliveries at the address you give us, and that your details are accurate.

You agree to keep your address current. If you move and do not update your record, deliveries will be sent to the address we hold.

5. Your Stoop number

Your Stoop number is yours to share with whoever you choose, and you are responsible for who you give it to. Anyone with your Stoop number and the last four digits of your phone number can have an order delivered to you by a participating shop, though they never see your address.

If you get deliveries you do not want, or you no longer want someone to have your number, delete your record and register again. You will get a new number, and shops can no longer look up the old one.

If someone is using Stoop to harass you, tell us at hello@sendastoop.com. We will review the lookup records and may suspend any shop account involved.

6. What you must not do

You must not:

  • register an address you are not entitled to receive deliveries at, or a phone number that is not yours
  • use Stoop to send anything unlawful, harassing or threatening to anyone
  • try to find out another person's address or phone number through Stoop
  • impersonate another person
  • access Stoop by any means other than the interface we provide, including scraping or automated requests
  • interfere with Stoop's security or operation

7. Confirming and deleting your record

We email you a link to confirm your address. Until you confirm, your number does not work and shops cannot look it up. If you do not confirm within 48 hours, we delete your details.

You can change or delete your details at any time through the link we email you. Deleting removes your name, phone number and address. Your Stoop number is retired and never reissued to anyone else.

8. Shops and senders are not us

We check shops before giving them access, and the Shop Terms forbid them from using your details for anything except the order they were given your number for. We do not control what shops, senders or carriers do, and we are not responsible for their acts or omissions. That includes a shop that misuses your details in breach of the Shop Terms.

If a shop misuses your details, we will investigate using our lookup records and may suspend or close its account. Any claim about an order, a delivery or a shop's conduct is between you and that shop or sender.

We do not verify the identity of senders.

9. What we do not promise

STOOP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT STOOP WILL BE AVAILABLE, UNINTERRUPTED OR ERROR FREE, OR THAT ANY ORDER WILL BE SENT, ACCEPTED OR DELIVERED ON TIME OR AT ALL.

We protect your details with the safeguards described in the Privacy Policy. No system is perfectly secure, and we cannot guarantee that your details will never be accessed without authorization.

10. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO STOOP
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO STOOP IS LIMITED TO $100

These limits apply whatever the legal basis of the claim, including contract, negligence and statute, and even if we were told the damage was possible.

Nothing in these terms limits liability for gross negligence, willful misconduct, or any other liability that the law does not allow to be limited.

11. Your responsibility to us

You will defend us and cover our losses, costs and reasonable legal fees arising from any claim that results from details you gave us that were not yours to give, your use of Stoop in a way these terms do not allow, or your breach of these terms.

12. Time limit for claims

To the extent the law allows, any claim you have against us must be brought within one year after it arises. After that, the claim is permanently barred.

13. Disputes and arbitration

13.1 Talk to us first. Before starting arbitration or a court case, email hello@sendastoop.com with a description of the problem and what you want. We will try to resolve it with you within 60 days.

13.2 Arbitration. If we cannot resolve it, you and we agree that any dispute arising from or related to Stoop or these terms will be resolved by binding individual arbitration, not in court. The American Arbitration Association will administer the arbitration under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The hearing will take place in the county where you live or by video, whichever you choose. Fees are paid as the Consumer Arbitration Rules provide.

13.3 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court for an order to stop misuse of Stoop or of personal information.

13.4 No class actions. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine more than one person's claims.

13.5 Opting out. You can opt out of this section 13 by emailing hello@sendastoop.com within 30 days of registering. Include your name, your Stoop number and a statement that you opt out of arbitration. Opting out does not affect the rest of these terms. If you registered before this version took effect, you have 30 days from the date we email you about it.

13.6 If part of this section fails. If a court decides that section 13.4 cannot be enforced for a particular claim, that claim will be decided in court and not in arbitration.

14. Governing law

These terms are governed by the laws of the State of New York, except that the Federal Arbitration Act governs section 13. Any dispute that is not arbitrated will be brought in the state or federal courts located in New York County, New York, and you and we each consent to those courts.

15. Changes to Stoop and these terms

Stoop is free for recipients. We may change or stop the service.

We may change these terms. If a change is material, we will email you at least 14 days before it takes effect. If you keep using Stoop after that, the new terms apply. If you do not agree, delete your record. A change to section 13 does not apply to a dispute you told us about before the change.

16. Suspension and ending

We may suspend or remove your record if you break these terms. You can delete your record at any time.

Sections 8 to 14 and 17 continue to apply after your record is deleted.

17. General

If any part of these terms cannot be enforced, the rest still applies.

If we do not enforce a right under these terms, we have not given it up.

We may transfer these terms to a successor, including a company we form to run Stoop or a buyer of Stoop's business. You may not transfer your rights under these terms.

You agree that we may send you notices about your record and these terms by email to the address you gave us.
